An Act 

To improve aviation security, and for other purposes. 

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, 

SECTION 1. SHORT TITLE. 

 This Act may be cited as the ‘‘Aviation and Transportation Security Act’’. 

TITLE I—AVIATION SECURITY SEC. 

109. ENHANCED SECURITY MEASURES. 

(a) IN GENERAL. The Under Secretary of Transportation for Security may take the following actions: 

     (7) Provide for the use of voice stress analysis, biometric, or other technologies to prevent a person who might pose a danger to air safety or security  from boarding the aircraft of an air carrier or foreign air carrier in air transportation or intrastate air transportation.

Government Safety Act

     The SAFETY Act provides two levels of liability protections to help promote the creation, deployment and use of anti-terrorism technologies:

     DESIGNATION: The seller's liability for products or services that are deemed "Designated Technologies" is limited to the amount of liability insurance that the Department of Homeland Security determines the seller must maintain. Designation can also be obtained for promising anti-terrorism technologies that are undergoing testing and evaluation. 

     CERTIFICATION: In addition to the benefits provided under Designation, Certification allows a seller of an anti-terrorism technology to assert the Government Contractor Defense for claims arising from acts of terrorism. Technologies that receive Certification will be placed on DHS's Approved Products List for Homeland Security.
